Child Support terms, definitions and procedures.  

  • Duration of child support ( I will give you legal definition.

  • The two major factors in calculating child support is income and the percentage of time the parent has the cihld.  Child support is calculated using  a computer program.  Calculationg support is income driven so one's personal living expenses are generally not a factor that can reduce support, but can actually increase it if one can not explain one's expenses if they exceed one's income.

  • Income and Expense Declaration is the form that a party completes when child support is at issue. 

  • Factors that may reduce one's support obligation:
           a. Support paid for children from other relationships, health insurance, work related expenes, and hardships, which   are considered by the court in lowering one's child support obligations.  These may include costs for transportation, for expenses for  other biological children from other relationships living with him. and a  party's medical needs.

  • Modification of Orders can occur whenever there is a change of circumstances, which is typcially an increase or decrease in income or custodial timeshare.

    a. Inputing income usually occurs when a party refuses to work or not work at one's earning capacity.
         c. Welfare reimbursement occurs when the custodial parents receives aid from the county and the payor's court order for child support goes to the County instead of the custodial parent. 
         d. Dept of Child Support Services ("DCSS") is the state agency that assists parents with child support issues, usually obtaining and enforcing orders. 
         e. Child support arrears can result in severe consequences if one owes them and does not address this problem.  One can have one's licenses suspended such as drivers, vocational, and professional licenses, and not being able to receive a passport.
